The law is clear if you rent out your property (or even a room within your home) then you have legal responsibilities to ensure the health and safety of your tenant, visitors and other people by keeping the property safe and free from health hazards.

However, where the landlord is managing the property him or herself, then the landlord takes on that responsibility, along with all the other legal requirements for health and safety such as annual gas checks etc.

Do all workplaces need a legionella risk assessment?

No matter how big or small your premises, if you have water systems in your workplace then you have a legal obligation to assess them for the risk of legionella.

The HSE’s Approved Code of Practice applies to any undertaking involving a work activity and to premises controlled in connection with a trade, business or commercial enterprise or undertaking.

It is the responsibility of employers to make sure that Legionella is controlled and cannot spread and that risk assessments are carried out to define potential sources for Legionella growth. There is one thing that you should always remember when dealing with Legionella bacteria:
